Bergen County teen facing child pornography charges

A Bergen County teenager is facing extremely serious charges after being accused of sharing and downloading “numerous” images and videos containing child pornography.

The Bergen County prosecutor said recently in a news release that the pornography allegedly involves pre-pubescent children engaged in sex acts.

The 16-year-old Garfield resident was arrested following an investigation by city police and the prosecutor’s Computer Crimes Unit. He was charged with possessing and distributing child pornography, and was released to his mother pending a court hearing.

Just because a person is a minor doesn’t mean he or she cannot be charged with crimes against children. As we have learned in many “sexting” cases in the past, even young people who share pornographic images of themselves with kids their own age could potentially face child pornography charges.

Although the 16-year-old in this case will likely be prosecuted as a juvenile, the charges he faces are still very serious and could affect his future for years to come. Accordingly, the teen will need an experienced criminal defense lawyer to stand up for his rights.

While prosecutors and the media often portray the facts of these cases in a light that is unfavorable to the suspect, there is often much more to the case than what meets the eye.

In any case involving allegations of computer and Internet sex crimes, an experienced attorney will conduct an in-depth investigation using forensic computer experts to determine when specific images were accessed, who else had access to the computer and if it is possible that the images were downloaded accidently.

Prosecutors pursue these cases aggressively, which is why it’s important to have a defense strategy that is just as aggressive.
